When a Buyer places an order through this
website they are agreeing to the terms and conditions detailed below. The
buyers statutory rights will not be affected.
DESCRIPTION
All drawings, descriptive matter and
specifications issued by the seller and that appear on the website are as
accurate as possible. The seller cannot be held responsible for any minor
changes (change in design i.e. pattern and/or colourways) done by the
manufacturer if the manufacturer does not inform the seller of these minor
alterations.
If the Buyer does not specify the colour of
the goods then the seller shall be entitled to send the Buyer goods in any
colour without notifying the Buyer. In the event that the Buyer does
specify a colour the seller reserves the right to offer an alternative if, for
whatever reason that particular colour becomes unavailable.
DELIVERY
If a Buyer fails to collect the goods on the
collection date agreed by both parties without notifying the seller then the
seller shall be entitled to cancel the order after 7 working days.
The seller aims to deliver items within 10
working days however if a delay occurs that is out of seller’s control then the
seller cannot be held responsible.
Delivery of the goods will be made as close
to the given delivery date as possible.
The seller will be entitled to deliver the
goods to any person that is present and who signs for the goods at the delivery
address.
The Buyer shall provide necessary equipment
and manpower at the delivery address to load and/or unload goods.
If the goods are damaged upon delivery the
Buyer has the right to reject the goods.
If a Buyer accepts the goods even when they
know they are damaged this is seen as the Buyer accepting the goods as they are
and the seller cannot be expected to refund/reimburse the Buyer after the goods
have been accepted.
If a Buyer accepts the goods and then a
fault/damage that wasn’t obvious becomes apparent then the Buyer shall notify the
seller in writing within a reasonable amount of time.
If the Buyer reports a fault/damage the Buyer
will make no further use of the goods until it is agreed by The seller.
The seller will endeavor to correct any
issues within a reasonable amount of time.
The seller cannot be made liable for any
faults caused by the manufacturer or any third party.
The Buyer can reject the goods without giving
any reason any time up to 7 working days after the Buyer receives the goods
providing the goods are in a condition that reflects its age and usage.
The goods shall be returned to The seller in this condition at the Buyers
expense. The Buyer is also responsible for the goods in transit and so should
take out reasonable insurance incase of loss or damage during transit. The
Buyer will need to notify the seller in writing that they are canceling the
contract before they return the goods to The seller. The goods shall be
returned to The seller within 10 working days after the Buyer has notified The
seller that they are canceling the contract. A refund will be given to
the Buyer (excluding delivery charges) within a reasonable amount of time but
no more than 30 days after the Buyer has cancelled the contract.
PAYMENT
The goods will not be sent to the Buyer until
the seller has received the full amount for the Goods.
DVLA REGISTRATION
DVLA Registration and Road Fund License will be included where stated. With offers where this is not stated, this will be charged for separately and must be added to the order.
QUALITY
The Buyer will give written notice to the
seller of any defect as soon as is possible after becoming aware of any
problem. If the problem was caused in transit then the Buyer will give
written notice within 24 hours of taking delivery of the motorcycle.
If any fault should become apparent the Buyer
will contact the seller in writing as soon as possible and the seller shall be
given a reasonable amount of time to assess the situation and offer a solution.
An independent professional may be needed to
assess any fault that becomes apparent if the seller can not physically see the
faulty vehicle (due to distance for example).
If an independent professional is required
then it will be agreed by both parties.
If a Buyer wishes to make a claim regarding
any warranty/guarantee then the Buyer will need to contact the seller in
writing as soon as any fault becomes apparent and stop using the vehicle until the
seller agrees to the use of the vehicle.
WARRANTY TERMS
All new motorcycles and scooters will be covered by a return to base parts and labour warranty. The duration of the warranty will be specified on the sellers website and confirmed on the sales invoice. This will also apply to the sale of some used motorcycles and scooters as specified at the point of sale. The warranty period will commence from the date the vehicle is supplied.
If the buyer is unable to return the vehicle to the seller in the event of a fault (due to distance) then the seller will supply any faulty part as covered by a valid warranty. The warranty will then be deemed a parts only warranty and as such will not cover any third party labour or recovery charges.
The warranty for new motorcycles and scooters will be subject to the manufacturers service schedule being maintained at the specified intervals as outlined in the service book. Failure to maintain the manufacturers service schedule may result in the cancellation of the warranty.
Charges for routine services as outlined in the service book will be met by the buyer.
The seller can not be expected to adhere to
any warranty/guarantee if the Buyer fails to maintain the vehicle as instructed
(written or verbally) or as a vehicle should be maintained by common sense.
WARRANTY EXCLUSIONS
The warranty does not cover the following:
a) Any parts that are subject to everyday wear and tear which include but are not limited to the following: tyres, tubes, spark plugs, filters, cables, lights, bulbs, mirrors, batteries, chains, belts, bearings, fairings, brake pads, brake shoes, clutch plates, levers, sprockets, fuses, bushes, rubber parts etc.
b) Any vehicle used in competitive or recreational sporting events at any level including but not limited to: Trails, Greenlaning, Racing etc.
c) Any parts that are not serviced, maintained, used or stored in accordance with the recommended procedures, good trade practice or common sense.
d) Any vehicle whose mileage exceeds 8000 miles in 1 year or 3500 miles in the first 6 months due to the running in period, or has been resold / re-registered to an individual or business or has been used for training, renting or leasing.
e) Any labour accrued by inspection, routine servicing and maintenance of the vehicle.
f) Any vehicles that have been tuned, modified or fiited with parts that are not supplied by the seller.
COMMUNICATIONS
All communications to the seller regarding
any complaints will be deemed as to be received only if they are sent via
pre-paid registered or recorded delivery.
DATA PROTECTION
Any details given to the seller will not be
passed to any other party.
